You should carefully read the following terms and conditions. Your purchase or use of Affiliate Admin products implies that you have read and accepted these terms and conditions.
1. Downloadable Software
You may not de-compile, reverse engineer, disassemble or otherwise reduce any downloadable software available at the web site of Affiliate Admin to a human perceivable form. You may not modify, rent or resell for profit these software, or create derivative works based upon the software. You may not publicize or distribute any registration code algorithms, information, or registration codes used by the software without permission of Affiliate Admin. You may not use any registration codes for the Software that have not been purchased from Affiliate Admin or an authorized representative of Affiliate Admin. You accept responsibility for any network usage costs or any other costs incurred by using this software.
By using any Affiliate Admin software or storing the software on a computer hard drive (or other media), you are agreeing to be bound by the terms of use. If you do not agree to these terms uninstall and delete the software from all storage media.
NO WARRANTIES. - Affiliate Admin EXPRESSLY DISCLAIMS ANY WARRANTY for any SOFTWARE. The SOFTWARE and any related documentation is provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or non-infringement. The entire risk arising out of use or performance of the SOFTWARE remains with you.
SOFTWARE AVAILABLE FROM Affiliate Admin IS NOT FAULT TOLERANT AND SHOULD NOT BE USED IN ANY ENVIRONMENT WHICH REQUIRES THIS.
NO LIABILITY FOR DAMAGES. In no event shall Affiliate Admin or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use SOFTWARE, EVEN IF Affiliate Admin HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Affiliate Admin may link some of the buttons within the software to third party web sites. Affiliate Admin has no control over the contents of these sites and as such makes no warranty, either express or implied, as to the products or services available on third party sites.
2. LICENSE
Affiliate Admin grants you a nonexclusive limited license to use the software products sold through our web site in accordance with these Terms of Use and Conditions (the "license") issued by Affiliate Admin.
a) UNAUTHORIZED USE
You may not place any of our products, modified or unmodified, on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent from our company.
b) ASSIGNABILITY
You may not sub-license, assign, or transfer this license to anyone else without prior written consent from Affiliate Admin.
c) ACCESS AND DOWNLOADS
Your username and password is for your personal use only. If we discover that you share or distribute your username and password you understand that we will terminate your membership account with us immediately. Futhermore, your IP address, credit card and email address may be banned for a period of up to 5 years. You are also not permitted to use a spider, web crawler, or other similar automated tool to download the content from our site.
d) Limitation of Liability
Customer acknowledges that Affiliate Admin shall not assume or have any liability for any action by Affiliate Admin or its affiliates and licensees with respect to the use of software products. To the fullest extent permitted by applicable law, including but not limited to, negligence, Affiliate Admin shall not be liable to customer for any indirect, incidental, special or consequential damages (including, without limitation, damages or loss of business, lost profits, business interruption, loss of business information, or any other pecuniary loss, even if Affiliate Admin has been advised of the possibility of such damages, in connection with Affiliate Admin or with any other product or service provided by Affiliate Admin, or resulting from the use of or the inability to use the Website or any transaction entered into through or from Affiliate Admin, or from unauthorized access to or alteration of your transmissions, data, or account. Customer specifically agrees that Affiliate Admin is not responsible or liable to customer or anyone else for any threatening, defamatory, obscene, offensive or illegal conduct or speech of any other party or any infringement or violation of another's rights, including intellectual property rights, rights of publicity, or rights of privacy. Affiliate Admin's liability to you for breach of this agreement is limited solely to $10.
e) Governing Law
Customer understands that for all disputes, with regard to any of Affiliate Admin services or any term listed in this policy, the only jurisdiction that shall be used in determining liability is the court situated in the Netherlands. If Affiliate Admin is obligated to go to court, rather than arbitration, to enforce any of its rights, or to collect any fees, you agree to reimburse Affiliate Admin for its legal fees, costs and disbursements if Affiliate Admin is successful. You agree that the Courts of the Netherlands are the agreed and appropriate forums for any such suit, and consent to service of process by registered mail or overnight courier with proof of delivery.
f) Severability
If any term or provision of this Agreement is found to be unenforceable for any reason, this Agreement shall remain in full force and effect and shall be fully enforceable on its remaining terms and conditions.
You understand that Affiliate Admin reserves the right to change or modify these terms with no prior notice.
